Terms of Service

These Terms of Service ("Terms") govern access to and use of Sundog Labs (sundoglabs.ca) and related tenant workspaces operated by BRH Consulting ("we", "us"). By using the platform, you agree to these Terms.

The service

Sundog Labs provides hosted, multi-tenant web applications for businesses. Each tenant receives a dedicated subdomain and workspace. Features vary by product suite (for example, field service invoicing or foot-care practice management). We may add, change, or discontinue features with reasonable notice where practical.

Accounts and access

• You must provide accurate account information and keep credentials confidential.
• Tenant owners and admins control membership, settings, and integrations (including connected email) for their workspace.
• You are responsible for activity under your account and for ensuring your users comply with these Terms.

Acceptable use

You agree not to:

• Use the platform for unlawful, harmful, or fraudulent purposes.
• Send unsolicited bulk email or messages that violate applicable law.
• Attempt to bypass security, access another tenant's data, or interfere with the service.
• Upload malware or material that infringes intellectual property or privacy rights.

Tenants are data controllers for the business and client information they store in their workspace. You must have a lawful basis to collect and process that information.

Email integration

Where available, a tenant admin may connect a Gmail account so authorized users can send email through that mailbox. By connecting Gmail, the admin authorizes us to send messages they request on their behalf using Google's APIs. The admin can revoke access at any time. You remain responsible for the content of messages sent from your workspace.

Intellectual property

We retain ownership of the platform, software, and branding. You retain ownership of content you submit to your workspace. You grant us a limited license to host, process, and display that content solely to provide the service.

Availability and support

We strive for reliable operation but do not guarantee uninterrupted or error-free service. Maintenance, third-party outages, or force majeure may cause downtime. Support is provided on a reasonable-efforts basis according to your agreement with us, if any.

Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS IF NO FEES WERE PAID.

Termination

We may suspend or terminate access if you materially breach these Terms or if required for security or legal reasons. You may stop using the service at any time. Provisions that by nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Courts in Ontario will have exclusive jurisdiction, subject to mandatory consumer protections that may apply in your jurisdiction.

Changes

We may modify these Terms by posting an updated version on this page. If changes are material, we will make reasonable efforts to notify tenant admins. Continued use after the effective date constitutes acceptance.
